The Karnataka Real Estate Regulatory Authority, known as KRERA, has directed Ishtika Homes Pvt Ltd to fix a meeting with Asastya buyers to discuss the possibility of the promised rooftop swimming pool. The order stated that the builder must either build the pool now or refund the cost based on the poll of all the buyers.
The swimming pool was promised at the time of sale, but it was not built. The complaint was filed by all the buyers after the rooftop pool and sewage treatment plant (STP) were left incomplete. The project, named Asastya, is located in North Bengaluru with 60 housing units, all of which have been handed over to the buyers.
The buyers have said that the builder did not deliver key features mentioned in the project brochure. One major issue is the lack of water supply from the BWSSB. Buyers claim that the builder took initial deposits assuring a BWSSB connection would be given, but no timeline was shared, and there was no progress. As a result, residents are forced to depend on borewell water for daily use. The builder has now fitted a water treatment plant to address potential health risks, but residents complain that it never functioned properly. A list of questions has now been sent to the developer.
The KRERA order noted that although possession has been given, the rooftop pool was not built due to differing opinions among buyers. The developer stated they will either construct the facility or issue refunds based on the owners’ decision. In response, KRERA has instructed the builder to conduct a joint meeting of all buyers within 30 days of the order and take necessary action.
The builder also argued that the project has a BWSSB connection and that the issues are due to poor maintenance by residents. However, KRERA stated that blaming buyers for system failures is not reasonable.
The promoter claimed that the STP became non-functional due to lack of maintenance but asserted that it is working now. As a result, the Authority has asked the builder to submit a third-party verified report from a capable engineer.
KRERA has also directed the builder to provide a full written statement within 10 days, clarifying that the formation of the owners’ association will not interfere with any complaints.
